Privacy Policy (Effective Date: June 10, 2026)

1. Overview & Data Philosophy

 

Praxis Performance respects your privacy and is committed to protecting your personal information. We believe you should know what information we collect, why we collect it, how we use it, and the choices you have regarding your information.


We collect only the information needed to provide our coaching services, communicate with you, manage your account, meet legal and business obligations, and improve your experience with Praxis Performance. We do not sell your personal information.


This Privacy Policy explains how information is collected through our website, client portal, and other services, how it is used, how it is protected, and the rights available to you under applicable law. 


2. Operational Scope & Voluntary Data Submission

Unlike a typical informational website, Praxis Performance is designed to receive and manage information that supports your coaching experience. This may include account information, performance assessments, movement analysis, performance diagnostics, coaching records, individualized programming, and other information you choose to provide as part of your participation.


When you use our website, client portal, complete forms, upload documents, or participate in our services, you are voluntarily providing personal, performance, biometric, and fitness-related information so we can deliver, personalize, and manage your coaching experience. We collect only the information reasonably needed to provide our services, maintain your records, communicate with you, and support your progress over time.


3. Non-Covered Entity (NCE) Status & FTC/CCPA Framework

Praxis Performance is not a HIPAA Covered Entity or a HIPAA Business Associate. Information you provide to us is not governed by the HIPAA Privacy Rule. 


Instead, your personal information, performance information, and biometric information are protected under applicable federal and California privacy laws, including the Federal Trade Commission (FTC) Health Breach Notification Rule, the California Consumer Privacy Act (CCPA), and the California Privacy Rights Act (CPRA).


We are committed to protecting your information, limiting access to those who need it, and using it only for the purposes described in this Privacy Policy.


4. Information We Intentionally Collect

To provide our services, we collect information you choose to share with us, along with information needed to manage your account and coaching experience. Depending on how you use our services, this may include: 

  • Personal Identifiers: Your name, email address, mailing address, telephone number, and other contact information. 
  • Performance & Biometric Information: Performance assessments, movement analysis, performance diagnostics, body composition results, coaching notes, training records, progress measurements, and other information related to your coaching experience. 
  • Supporting Documentation: Documents you choose to provide, including Letters of Medical Necessity (LMNs), referral documentation, National Provider Identifier (NPI) information, or other records that support your participation or qualified pricing. 
  • Website & Usage Information: Information such as your browser type, device information, IP address, and pages visited to help us operate, maintain, and improve our website and online services.


5. Automated Systems & Technology Tools

Praxis Performance uses technology to help manage day to day operations, improve accuracy, and provide a better client experience.


These systems may be used for data storage, scheduling, session documentation, communication, billing, recordkeeping, and other administrative functions.


Technology helps us work more efficiently, but it does not replace professional judgment. Information generated or organized through these systems is reviewed and used to support the services we provide to you. 


6. How We Use Your Information

Praxis Performance uses your personal and performance information only to operate our business and provide the services you request. We do not use your information for purposes unrelated to your coaching experience. 


Your information may be used to:

  • Provide, personalize, and adjust your coaching, individualized programming, performance assessments, and other services. 
  • Create and manage your account, schedule appointments, process payments, and apply qualified pricing or rate adjustments when appropriate. 
  • Respond to your questions, communicate about your account, and provide important service, legal, or operational notices. 
  • Analyze de-identified and aggregated performance trends to help improve our services, provided you have not exercised your right to opt out where applicable.


7. Non-Disclosure & Information Sharing

Praxis Performance does not sell your personal, performance, or health-related information. We share information only when it is necessary to provide our services, when you authorize us to do so, or when required by law. 


Your information may be shared with:

  • Service Providers: Trusted companies that help us operate our business, including website hosting, payment processing, scheduling, communications, and other business services. These providers are required to protect your information and may only use it to perform services on our behalf. 
  • Authorized Individuals or Healthcare Providers: When you provide written authorization, we may share information with your physician, healthcare provider, or another person you have designated. 
  • Legal Requirements: When disclosure is required to comply with applicable laws, legal processes, court orders, or lawful government requests, or to protect the rights, safety, or property of Praxis Performance or others.


8. Data Security & Limitations

Praxis Performance uses reasonable administrative, technical, and physical safeguards to help protect your personal and performance information from unauthorized access, use, or disclosure. 


We also work with service providers that maintain security measures appropriate for the services they provide.


While we take reasonable steps to protect your information, no method of transmitting information over the internet or storing electronic data can be guaranteed to be completely secure. Because of this, we cannot guarantee absolute security or confidentiality. 


9. Data Retention Parameters

Praxis Performance retains your personal and performance information only for as long as necessary to provide our services, meet our contractual obligations, comply with applicable laws, and maintain required business records.


Some information may remain in our business systems after your services end because of legal, regulatory, accounting, operational, or platform requirements. When information is no longer required, we will securely destroy, de-identify, or otherwise limit its use to the extent permitted by applicable law and the capabilities of the systems we use.


10. Your Rights & California Sovereignty Choices

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). Subject to applicable law, you may:

  • Request access to the personal information we maintain about you.
  • Request correction of inaccurate personal information.
  • Request deletion of your personal information, subject to applicable legal exceptions.
  • Limit the use of your sensitive personal information where permitted by law.
  • Opt out of the sharing of your personal information where applicable.
  • Opt out of promotional media or participation in de-identified, aggregated performance reporting by providing written notice.

We will respond to verified requests in accordance with applicable law.


11. Policy Modifications

Praxis Performance may update this Privacy Policy from time to time to reflect changes in our services, business practices, or applicable laws.


When we make a material change, we will update the Effective Date at the top of this Privacy Policy and publish the revised version on our website.


Your continued use of our website, client portal, or services after an updated Privacy Policy becomes effective constitutes your acceptance of the revised policy.
